How Engagements Work

I am instructed across a range of engagement types, tailored to the needs of the matter and the stage of the dispute.

Party-Appointed Expert

Instructed by one side to provide independent expert evidence in support of their case. I produce a CPR Part 35 compliant report setting out my opinion, and am available for oral testimony at trial or hearing. My duty is to the court, regardless of who instructs me.

Single Joint Expert

Appointed by agreement between the parties or by the court to provide a single, independent expert opinion on technical issues. I have served as SJE in both civil and family proceedings.

Advisory & Pre-Dispute

Engaged before or alongside formal proceedings to assess the technical merits of a potential claim, review evidence, or advise on strategy. This can include technology project health checks, independent code reviews, or expert input on settlement negotiations.

International Arbitration

Experience providing expert evidence under JAMS, LCIA, and DIAC rules. I produce written reports and give oral evidence at hearings, adapting to the procedural requirements of the relevant institution.

Frequently Asked Questions

What types of proceedings do you accept instructions for?
I accept instructions across a range of proceedings, including the High Court (Technology and Construction Court, King's Bench Division, Chancery Division), County Court, Competition Appeal Tribunal, Family Court, and regulatory investigations. I also accept instructions in international arbitration under institutional rules including JAMS, LCIA, DIAC, and ICC, as well as ad hoc arbitrations. I am instructed by both claimants and defendants; my duty is to the court regardless of which party instructs me.
Can you provide a preliminary view before formal instruction?
Yes. I am happy to discuss a matter on a preliminary basis to help determine whether technology expert evidence would be of assistance, and whether the issues fall within my expertise. There is no charge for this initial discussion. Any preliminary view expressed is necessarily subject to a full review of the relevant evidence and materials.
Do you accept instructions from both claimants and defendants?
Yes. Under CPR Part 35.3, an expert's overriding duty is to the court, and this duty takes precedence over any obligation to the party from whom the expert receives instructions. I approach every instruction on this basis, regardless of whether I am instructed by the claimant, defendant, or appointed as a single joint expert.
Do you provide oral testimony?
Yes. I have experience giving oral evidence, including examination-in-chief, cross-examination, and concurrent evidence sessions (sometimes referred to as "hot-tubbing"). I hold a Cardiff University Bond Solon Expert Witness Certificate, which includes assessed training in courtroom testimony and cross-examination technique.
Do you accept instructions in international arbitration?
Yes. I have provided expert evidence in international arbitrations under JAMS, LCIA, DIAC, ICC, and ad hoc rules. Jurisdictions in which I have been instructed include England and Wales, the United States, Europe, and the Middle East. I produce written reports and give oral evidence at hearings, adapting to the procedural requirements of the relevant institution.
What are your fees?
Fees are charged on a time basis. At the outset of every instruction, I provide a detailed fee estimate based on the proposed scope of work and methodology. I report regularly against budget throughout the engagement so that there are no surprises. Specific rates are available on request and are provided as part of the initial scope and fee estimate.
